방관(傍觀)은 ‘곁에서 보고만 있다’는 뜻으로, 다른 사람의 행동이나 어떤 사건에 대해 직접적으로 개입하거나 돕지 않고 그냥 지켜보는 것을 의미합니다. 방관은 대체로 법적 책임을 묻기 어렵습니다. 예를 들어, 길에서 누군가 다투는 것을 보면서 그냥 지나치는 행위는 방관에 해당합니다. 이는 형법상 범죄를 구성하지 않는 경우가 대부분입니다. 방조(幇助)는 ‘도와서 거들다’라는 뜻으로, 다른 사람의 범죄 행위를 돕는 것을 말합니다. 방조는 형법상 종범(從犯)에 해당하며, 정범(正犯)의 범죄를 돕는 행위로서 처벌 대상이 됩니다. 방조는 정신적으로 돕거나(예: ‘잘했다’, ‘계속해라’ 등 격려), 물질적으로 돕는 것(예: 흉기를 빌려주는 행위)을 모두 포함합니다.

However, if someone shakes the jar and then sets it down, the ants will start fighting each other, dividing into opposing groups. The black ants see the fire ants as enemies, and the fire ants see the black ants as enemies. But who is the real enemy? When conflicts arise, let’s first ask ourselves: Who shook the jar?
